Patent Reform: What is a ?Patent Troll’?

The term “patent troll” has more than one definition. Basically, it is a person or company that enforces a patent in a court of law that they are not currently practicing. This means that a person who owns the patent sues other companies for using the technology protected by the patent. In order for this person to be considered a patent troll, he has to be considered to be defending the patent very aggressively.

A person will be called a patent troll, a pejorative name, when he has purchased the patent with the intention of aggressively defending it in a court of law. This happens when someone purchases the patent from a bankrupt company, for example, that has been forced to sell its patents due to its financial difficulties. The patent troll discovers who has been profiting from the technology that came from the bankrupt company’s patents, and these are the companies that the patent troll sets his sights on.

The other part of the definition of being a patent troll means that the person who purchased the patent may or may not have had the intention of ever using it. In other words, the patent troll does not necessarily have to take advantage of the patent that was purchased in order to make products and make a profit from it. The main purpose of purchasing the patent was to be able to have a reason to sue other companies and share in the profits that they have made from the technology. This fact makes the patent troll a despised entity in the business world.

Other people who may be considered to be patent trolls are in companies that enforce their patents, but do not perform any research of their own. They do not have research and development departments in their firms, because they are not going to manufacture any products or services based on the patent. They are seen as people who are taking advantage of the companies that are researching the technology and developing new innovations.

If a company has been created with the sole purpose of enforcing its patent rights against other companies, it is said to be a patent troll. In the business world, patent troll lawsuits are considered to be frivolous along the lines of suing McDonald’s after having been burned by the hot coffee. Those companies on the receiving end of these lawsuits often choose to settle out of court, because it would cost them a lot more to defend themselves than to agree to pay hundreds of thousands of dollars. Otherwise, they may have millions of dollars in legal fees to contend with whether they win or not. Anyone referred to as a patent troll, is not someone well respected in the business community.

Patent reform in the US, as represented by the America Invents Act stands to change the playing field quite significantly.

The Evolution Of Troll Beads

There are a great many varieties of charm bracelets on the market today and you would be hard pushed to go into a jewellers either online or in the high street and not find a variety of brands.

The idea behind the charm bracelet is that it gives you the chance to be creative and put together your very own collection of beads on a beautifully constructed necklace. You can choose different designs and colours to match your outfit and suit your mood.

As mentioned, there are a number of brands that are available on the high street and online, one of these is known as Troll beads. In this article I will be looking at the origin of the brand and its importance in the market place.

So firstly let’s focus on what Troll beads actually are, well they are actually one of the very first incarnations of the modern charm bead and bracelet concept.

The idea came to a silversmith in Denmark way back in 1976, over 30 years ago, his name was Soren Nielsen and he designed the very first of these beads. The original design was one of a small silver charm, there would be small hole cut through the centre of the charm allowing the wearer to place them one by one onto a piece of leather. So this is how the Troll beads actually came about, but where did they get their unusual name from? The original designs of the beads were very obscure and it was thought that each one of them represented the features of a small troll and so the name Troll beads stuck.

The Troll beads themselves were designed and sold through the jewellers owned by Nielsen’s father in the capital city of Denmark – Copenhagen. As the years passed by it became clear that there was room for expansion and Lise, Soren’s sister, opened a jewellers in 1987, this was the second store owned by the family and was situated in Lyngby. During the 1980’s the Troll beads brand introduced their most well known chain or bracelet – the charm bracelet. The first incarnation allowed the user to open the lock at the end of the bracelet and place differing combinations of Troll beads on, therefore creating their own piece of jewellery.

Over the last couple of decades, charm bracelets have really had a revival and are now available in all kinds of styles and designs. As you are probably aware, the charm bracelet is a whole jewellery category of its own. The Troll beads brand only started to export its jewellery in the 1990’s and as of this time the range of Troll beads that were available became more and more varied. No longer were they just silver, but now they were made out of 18-carat gold, pearls, precious and semi-precious stones, and glass.

The popularity and range of these Troll beads has grown and grown and you will find a vast array of different styles and colours from which you can create your perfect charm bracelet.

The Troll Story in Norway

When you are walking in the forest and along the river at night, remember you are not alone. There are little elves in the forest, and people in Norway call them the trolls.


Every nation has its own tradition legends about spirits. And for Norway, it is the troll. The trolls have long red nose, massive hair, and somewhat ugly. They are said to be the spirit of trees and the earliest conquer of Norway. The trolls are in charge of the night and the Norwegians are in charge of the day.


The first day I stepped into the earth of Norway, the sculptures of the trolls started to grab my eyes. They were really every where. They are at the doors of shops, in the train stations, by the street of the city and at the door of someone’s house. The bigger ones can be 2 meters tall and the smaller ones can be put into the pockets. But don’t try to make troubles with those little demons. I took a lot of photos of them as a sign of friendliness. At last I even brought a troll with a long braid back home.


The troll is the mascot of Norway. Many Norwegian grow up listening to the stories of the trolls. In those stories, the trolls are the earliest habitants in this land. They had families and people were divided into different tribes and they had their own kings. For example beside the lakes in the forests, there lived a kind of trolls named Nakens. They lived in the water. And besides the waterfalls and mills lived a kind of trolls named Falthergramenn, who were pretty good at playing violin. In one of those stories a famous violinist was once the student of the trolls.


The most interesting story about the trolls is that they sleep during the day and start doing thing at night. But once they play so happily and forget to hide themselves before the sun comes out, they will be turned into stones. In the stories, the trolls like to have porridge and it is said that their long noses are used to blend the porridge. So during Christmas the local people will put a bowl of porridge at the door of their houses for the trolls to enjoy their time of Christmas. The trolls are becoming more and more friendly.
